Bern Convention, Government Appeal: No project in Vjosa without drafting Management Plan

Commission: The Albanian Government to implement the recommendations issued in 2018

Strasbourg, Tirana, 8 December 2019. The Standing Committee of the Berne Convention has decided to keep open the case against the Albanian government over the Poçem and Kalivac hydropower plants planned to be built on the Vjosa River. At the same time, the commission urged the government to prepare the Integrated Basin Management Plan as well as the Strategic Environmental Assessment, including the social aspect, before any new development related to these hydropower projects is undertaken.

The decision was taken at the 39th meeting, held in Strasbourg on December 3-6, 2019, which also called for the implementation of Convention requirements under the 2018 Recommendations, when deciding to open the case against the government. The discussion on the issue of the Poçem and Kalivac hydropower plants took place in the absence of representatives of the Albanian government, who were urged to report urgently on the progress made in fulfilling the recommendations left last year.

The Vjosa River is a unique ecosystem of international importance, but it risks being alienated by plans to build more than 40 hydropower plants. “In the capacity of the complainant, we ask the Berne Convention to increase pressure on the Albanian government to implement the 2018 recommendations, according to which the government should have suspended the Poçem and Kalivac projects,” said Olsi Nika, EcoAlbania Executive Director and Coordinator of the “Save the Blue Heart of Europe” campaign.

Meanwhile, another development that will be followed with concern by the Berne Standing Committee is the plan to reduce the territory of the Vjosa-Narta Protected Landscape, which is also an Emerald area – part of the ecological network of areas of special conservation interest. “The Vjosa-Narta protected area is one of the most important areas of the Vjosa valley with a rich biodiversity and high natural integrity,” Nika added.

The Vjosa River is considered to be the last wild river in Europe as it flows uninterrupted along its entire length and forms a unique ecosystem of international importance.

Tirana, November 29th 2018 – The Bern Convention decided to open a case-file and called on the Albanian government to halt the hydropower plant projects on the Vjosa River. Instead, the government should prepare appropriate strategic environmental impact assessments and additional studies to evaluate the environmental impacts of the projected hydropower plants. The Vjosa is one of the very last unspoilt rivers of Europe. As part of the campaign “Save the Blue Heart of Europe”, environmental NGOs EuroNatur (Germany), Riverwatch (Austria) and EcoAlbania fight to protect the Vjosa.

The Bern Convention is among the most important nature conservation agreements in Europe. Accordingly, the decision is a moment of joy for EcoAlbania, who had filed the complaint. “The Vjosa river network is really unique and of pan-European value. Now we and the representatives of the Bern Convention have to keep a very close eye on what steps the Albanian government will take to implement the twelve recommendations adopted by the Standing Committee”, says EcoAlbania CEO Olsi Nika.

“The official decision to open a case-file further increases the pressure on the Government of Albania to take appropriate action. We will take advantage of this ground-breaking decision to step up our efforts to save the entire Vjosa from destruction by hydropower development”, says Theresa Schiller, project leader at EuroNatur.

The Bern Convention also gives credit to the nature conservation organisations’ efforts to collect data about the Vjosa ecosystem, thereby proving its outstanding value. “A wild-flowing river of this size, probably the last one in Europe, with such unique ecosystems and rich biodiversity should benefit from greater protection”, the Bern Convention Secretariat explained. “The positive attitude of the authorities towards the Bern Convention Recommendation is very welcomed and we hope to see quick progress on its implementation, which will be closely monitored.”

Bern Convention requests the suspension of Kalivaç and Poçem HPP projects

++12 recommendations to the Albanian Government regarding the plans for the HPP-s constructions on the Vjosa river++  

Tirana, 24.10.2018. The Standing Committee of Bern Convention published a draft with 12 recommendations addressed to the Albanian Government regarding the plans for the HPP constructions on the Vjosa river. It recommends to suspend the projects for both Kalivaç and Poçem hydropower plants – as their implementation would pose compliance concerns with the Bern Convention – until the necessary strategic planning and additional assessments are carried out.

The Bern Convention is one of the most important nature conservation conventions for the protection of biodiversity in Europe and Albania is a signatory to this convention. Its recommendations would be mandatory for the Albanian government leading up to the cancellation of the HPPs throughout the Vjosa valley.

“Two years ago we submitted a complaint to the Bern Convention, explaining that the construction of the HPPs in Vjosa, doesn’t go in line with several of its articles. Today, after a continuous commitment, the Bureau of the Convention comes with a report and a series of recommendations that the Albanian government has the obligation to consider. ” said Olsi Nika, representative of EcoAlbania.

Among its recommendations, the Convention urges the Albanian Government to prepare an integrated River Basin Management plan and strategic environmental impact assessment, as well as to undertake a thorough consultation with local people. Furthermore it recommends the government to develop a study of the potential impacts of Poçem and Kalivaç HPP schemes on the sediment regime of the Vjosa River and implications for the environment and repeat the EIA study for the Poçem HPP project.

These recommendations will be discussed by the Standing Committee on the 38th  meeting that will be held on 27-30th of November in Strasbourg – giving a chance to the opening of the Vjosa case at the Bern Convention.

Currently, the Albanian government has signed the concession contract for the Kalivaç hydropower plant with the coalition of companies “Fusha Sh.p.k” and “Ayen Enerji”. To the last one was given the concession for construction of the Poçem hydropower project, whose works have been stopped after the decision of the  Albanian Administrative Court. Both hydropower plants are planned on the lower reaches of the Vjosa and would destroy a particularly valuable section of the river.

Representatives of the Bern Convention visited the Vjosa in order to investigate to which extent plans for hydropower development are jeopardizing the objectives of the Bern Convention. The on-the-spot appraisal was accompanied by an independent expert.

The Bern Convention is one of the most important nature conservation conventions for the protection of biodiversity in Europe. Albania is a signatory to the convention. Within the framework of the Save the Blue Heart campaign, we have repeatedly drawn the Convention’s attention to the acute threat the Vjosa is facing due to hydropower projects. Species and habitats that are protected under the Bern Convention, such as the Narta Lagoon near the mouth of the Vjosa in the Adriatic Sea, would be affected.

At the on-the-spot appraial, Iva Obretenova from the Bern Convention Secretariat stressed the uniqueness of the Vjosa once more: “There are indications, also provided by researchers and civil society, that the Vjosa River system is very rich in biodiversity and offering unique habitats and ecosystems of European importance. The Albanian authorities should explore the area thoroughly as it might be offering relevant locations for the completion of the Emerald Network in the country.” Emerald sides are usually proposed to the Bern Convention by the countries and can achieve the same protection status as Natura 2000 sites in EU countries.

At present, however, the Albanian government appears to be indifferent towards its obligations to preserve European natural heritage: concurrent with the on-the-spot appraisal of the Bern Convention, the concession contract for the hydropower plant “Kalivac” was signed according to our information – even though the required environmental permit has not been granted yet. The concession contract was signed with the Turkish company which had previously been granted the construction permit for the hydropower project Pocem, which has since been stopped by the Albanian Administrative Court. Both hydropower plants are planned on the lower reaches of the Vjosa and would destroy a particularly valuable section of the river.

This step is a slap in the face of the Bern Convention,” comments Theresa Schiller, Blue Heart campaign coordinator at EuroNatur. “Fortunately, the Bern Convention takes the Vjosa case very seriously. Now is the time to take action: the Bern Convention must urgently provide the Albanian government with clear recommendation to permanently protect this unique European natural heritage, before it is too late,
